Service description and general definitions

(1) The Web site is a service by the company called Bonetti Pubblicità srl with legal and operational headquarters in Reggio Emilia (henceforth "Crearti").

(2) The Crearti Web site offers to all users a service consisting of the receipt, publication, printing on canvas and sending files containing digital images sent by registered users and according to the format and procedures adopted by them.

(3) The terms and conditions described here are applied to each Customer and / or Web Site guest and are the basis of any contract between Crearti and the customer.

(4) Crearti always reserves the right to vary, as per its discretion, the terms and conditions of service, notifying to the user these changes trough a notice published on its website and / or by sending e-mail. The customer is obliged to accept these changes made, however, except the right to terminate the contract.

Availability and purchase modality

 (1) Crearti guarantees to make all the possible to ensure to the Customers availability of the online services of this Web Site. Temporary interruptions of service may be due to possible technical reasons or other causes. Crearti will endeavour to inform its users as efficiently as possible on the nature and duration of any service. Similarly, Crearti do not guarantee the functioning and quality of Internet out of our site. The Client, once send the order,  explicitly accepts all the conditions of this regulation and the fact that Crearti can not be responsible for any modification, suspension or interruption of the site or services provided by Crearti through the site.

(2) The Customer can send digital images by sending an e-mail. Images must be in JPEG format (.jpg).

(3) Once insert the order, of every nature, through Crearti Web Site, this can’t be considered as accepted until the Customer will not receive a confirmation from Crearti. The confirmation can happen by e-mail. Every purchase order will be considered binding, once accepted the proposed agreement terms by the Customer and once that the order is confirmed.

Prices

(1) Prices not included delivery and packaging cost. 

(2) The post costs are added to the order during the confirmation process in accordance with the price list that you can see on Crearti Web Site.

(3) All the prices are in Euro and are valid until you can see them on Crearti Web Site.

If you order some items and the price is wrong, Crearti will contact the Customer in order to let him know the right price and ask for the order confirmation with the right price.

Payment forms

 (1)The customer can choose the payment form between the ones signalled by Crearti Web Site during the phase of purchase. It will no possible to change the payment form once finished the purchase order.

Replacement of the items with a manufacturing fault or damaged during the transport

(1) With reference to the print of photos on canvas, if the bought item on Crearti Web Sute has some manufacturing faults o is damaged during the transport, the Customer could ask for the replacement within 7 days from the reception of the goods, writing to Contact Center Crearti at service@crearti.eu. The e-mail might contain the description of the fault or the damaged of the item.

(2) The Customer can send back the fault or damaged item in its original package, which has to be intact in all its parts. Crearti reserves to replace the defective product or reimburse the customer by issuing a Credit note of an amount equal to the value of damaged or defective product.

Return rights

(1) The application of return right established by Italian jurisdiction considering the goods purchased on Crearti fixed the following particularities. With reference to the printing of photos and so all the items dealt with by Crearti, the return rights is not applicable (look at art. 4 e 5 d.lgs. 22.05.1999 n.185). These items are involved, in fact, in the category of customized goods and are chosen by the customer following his own willing, a type and a format choose by him between the so many goods proposed by Crearti.

(2) During the selection process of the item and the purchasing of it, the Customer can change his idea and cancel the purchase order. Once that he send the order, and Crearti starts the process of creation and delivery, the Customer can’t change his idea. This happen because the photographic material printed appositely for a Customer can’t be used for other one.

Items delivery

(1) Crearti undertakes to deliver the items through the way chosen by the Customer and to the address indicated by this during the purchasing process. The Customer is committed, under his own responsibility, to provide information as accurately as possible, complete and current as required by the order process.

(2) Any delay or missed deliveries of items can not be charged, nor attributable to Crearti, which considers the improved contract with the customer with the delivery of the goods to the company in charge of the delivery.

Responsibility and service limitations

(1) The user will be the only responsible of the picture contents that will be published and printed through Crearti, which has no right in this sense.

(2) The Customer keeps the intellectual propriety of the pictured sent to Crearti.

(3) If Crearti believes, in its sole discretion, that the conduct of Client can cause damage or that the service is used by the customer without having the full intellectual property or have An explicit authorization of use, Crearti reserves the right to take any measure it deems necessary, including the one to stay in immediate and with precaution the Service. It is subject to the right of Crearti to compensation for damage suffered.

(4) The Customer must have the legal right to use each picture that he will charge or order to print.

(5) Crearti reserves the broader right to send the material published on the site to the judicial authorities that make a specific request and to cooperate with those authorities if this becomes necessary. Crearti reserves also the right to denounce the authorities any act that is detrimental to human dignity, especially any act which shows an abuse and / or abuse against minors. Crearti will denounce, finally, to the authorities any external attempt to force the security systems of the site or that may in any way be regarded as hostile.

Disclaim of responsibility

(1) Customer raises Crearti from any liability resulting from violation of law that protects the copyright and any content that may in some way be offensive or defamatory to third parties. In this way the customer assumes every responsibility regarding the publication of pictures on their website.

(2) Crearti disclaims any responsibility for the total or partial loss of the images on its website. Then, it declines any responsibility for defects or lack of quality of goods, tools, applications, including in the service, made available or related to the same and because of the consequences which may result to customers from possible malfunction or damages and losses of profits that can be achieved through the use of the Service.

(3) The customer is obliged to maintain free Crearti, associated companies, subsidiaries ones, branches, employees from any claims, dispute, including any burden and expense, also with a legal nature, arising out of Service by the customer.

(4) It is essential to clarify that Crearti is unable to verify the origin and nature of content and images that are published using the service on which, therefore, it can not engage in any form of control. So Crearti excludes any liability if, through the use of the Service, the customer reaches the consultation of images that he do not like.

(5) Crearti disclaims any responsibility regarding the use that the Customer will do about instruments, information and images obtained through the Service, particularly when this use should be not in accordance with the laws. Thus Crearti reserves the right not to publish and / or delete images that are even partially or covertly due to the assumptions above.

Privacy

(1)  The collection and processing by Crearti of the data provided by the Customer occurring in compliance with D.lgs. No 196/2003 and any other legislation regarding the protection of privacy.

(2) Personal data of the Customer, which Crearti assure the security in respect of that legislation, will be processed, communicated and disseminated, even with the aid of electronic or automated, directly and / or through third parties for purposes related to ' purchase of products that fall under the "supply Crearti" for statistical purposes for sending advertising and marketing of our products and services.

(3) The customer is entitled to exercise the rights recognized by. 7 of the Privacy Code (formerly art. 13 of Law No 675/1996). By accepting the conditions of service and purchase the customer expresses consent to the processing of their personal data for purposes related to the management of the order. The use of data for commercial purposes is, however, subject to an approval of a voluntary nature by the customer.

Copyright

(1) The Customer must have the legal right to use each picture that will be charged or order to print.

(2) The Customer guaranteed a royalty-free licence for the conservation, print, copy, download, delivery and distribution of the pictures managed during the service execution made for him by Crearti.

Applicable law and jurisdiction

 (1) The use of Crearti service is subject to the conditions dictated in this section "Terms and Conditions." Crearti is subject solely to European legislation. The only European Court has jurisdiction over all cases opened in connection with the use of Crearti.
